Who we are
Welcome to Rememories™. These Terms of Use ("Terms") govern your access to and use of the Rememories mobile application and website (the "Service"). The Service is provided by Humazing Pty Ltd (ABN 72 652 706 637). Throughout these Terms, "we," "us," and "the Company" mean Humazing Pty Ltd in its capacity as operator of the Service—not Bullseye Software Pty Ltd, except where we expressly refer to intellectual property ownership below.
Important Notice regarding Australian Consumer Law: Nothing in these Terms is intended to exclude, restrict, or modify any non-excludable consumer guarantees or rights you may have under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law (ACL).
1. Acceptance of Terms
By creating an account, uploading a photo, or "starting a job" within Rememories, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
2. Using the Service
You agree to use Rememories lawfully and responsibly. You must not:
- Misuse, disrupt, or attempt unauthorized access to our servers or AI engine.
- Reverse engineer or copy the underlying cinematic templates or proprietary software.
- Use the Service to harass, threaten, or infringe upon the rights of others.
3. Your Content & Ownership
You retain full ownership of the original content you upload (photos, audio, or messages). By submitting a "Job" to Rememories, you grant Humazing Pty Ltd a worldwide, non-exclusive, royalty-free license to host, process, and store your content solely for the purpose of creating and delivering your video greeting cards.
Intellectual property in the Service output:While you own your source photos, you acknowledge that the Rememories™ brand and product identity, the specific cinematic effects, AI-driven animations, transitions, and licensed music used to create the "Living Movie," and related materials, are the intellectual property of Bullseye Software Pty Ltd (ABN 56 652 706 128) and/or its licensors, and are used by Humazing Pty Ltd under licence in providing the Service. Humazing Pty Ltd grants you a personal, perpetual, non-commercial licence to share and display the resulting movie.
4. Safety & Legal Review
To maintain a safe and respectful community, we utilize both automated AI filters and manual human review to screen uploads for compliance with our Acceptable Use Policy and applicable Australian law.
Rejection of Jobs:We reserve the right to reject any Job and refuse to process any image that we, in our sole discretion, determine to be illegal, explicit, abusive, or an infringement of a third party's copyright.
Refunds on Rejected Jobs: Where a Job is rejected for a manifest, deliberate, or serious breach of these Terms (such as uploading prohibited or illegal material), we reserve the right to withhold any fees paid, to the fullest extent permitted by law. Where we offer a refund in other cases, the form of that refund (including whether by payment to your original payment method or by credit to your account balance) is governed by Account balance & credits below, subject to the ACL.
Law Enforcement: We may refer illegal material and related account information to the Australian Federal Police or other competent authorities where required by law.
5. Indemnity
You agree to indemnify, defend, and hold harmless Humazing Pty Ltd (ABN 72 652 706 637) and its directors and employees and agents from any claims, losses, or legal fees arising out of:
- Copyright Infringement:Any claim that you used photos, music, or likenesses without the owner's authority.
- Privacy & Publicity:Any claim that your content violates a third party's privacy rights (e.g., animating a person without their consent).
- Misuse: Your breach of these Terms or applicable law.
6. Our Melted Heart Promise (Satisfaction Guarantee)
We want your "Cinematic Hug" to be perfect. Our guarantee is offered in good faith:
- 14-Day Window: If you are genuinely dissatisfied with the cinematic quality of your movie, you may request a refund within 14 days of completion. If we approve a refund under this Promise, we may provide it as a payment reversal or as account credit in accordance with Account balance & credits (section 7), always subject to your non-excludable rights under the ACL.
- AI Variance:You acknowledge that AI-powered generation is a "craft." Output quality depends heavily on the condition of your source material (lighting, focus, scan quality). We cannot guarantee a "perfect" render for poor-quality source photos.
- Fair Use: We reserve the right to refuse or revoke refunds in cases of suspected abuse, such as repeated claims or fraudulent activity.
7. Account balance & credits
Your account may include a balance (which may be displayed as credits or a dollar-equivalent amount) that we maintain for use only within the Service.
Credits we apply: We may, at our discretion, credit your balance for operational or promotional purposes (for example, testing, goodwill gestures, or compensation we choose to offer). Any such credits are not cash, are not transferable to third parties unless we expressly allow, and are subject to these Terms.
Refunds and your balance: Where we decide to refund fees for a Job (whether in connection with job rejection, our Melted Heart Promise, or otherwise), we may in our sole discretion provide that refund by crediting your balance or by refunding to your original payment method (or another method we agree). Nothing in these Terms requires us to offer you a choice of method where the law does not require it.
No cash withdrawal: A positive balance (including credits we have applied) is not redeemable or payable in cash, bank transfer, or any form other than as payment or partial payment for future Jobs on the Service. You agree that your sole use for a positive balance is to offset or pay for future fees for the Service.
Australian Consumer Law: Nothing in this section excludes, restricts, or modifies any consumer guarantee or remedy you cannot contract out of under the ACL. If you are entitled to a refund or other remedy under non-excludable consumer law, we will provide that remedy in accordance with the law (which may require a refund in a specific form).
8. Payments & Subscriptions
All fees for "Jobs" or subscriptions will be clearly presented in-app. Unless stated otherwise (or required by the ACL), fees are non-refundable except as provided under our Melted Heart Promise or as applied to your account balance under section 7.
9. Limitation of Liability
To the maximum extent permitted by law, the Service is provided "as is." Humazing Pty Ltd is not liable for any indirect, incidental, or consequential damages resulting from your use of the Service or the loss of any uploaded content. Please ensure you keep backups of your original photos.
10. Accounts & Security
You are responsible for the security of your account. If you suspect unauthorized access, contact us immediately.
11. Changes to These Terms
We may update these Terms to reflect changes in our Service or the law. Continued use of Rememories following an update constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.
